.EU Domain Names

Instra Corporation Now an Official .EU Registrar!

We are happy to announce that our application to become an officially accredited .EU Registrar, has been accepted by EURid and our .EU Registration system is now ready to confirm your pre-registrations.

Even though actual registrations will not be submitted to EUrid until 7 December 2005 for Sunrise (when those with prior rights may apply for specific .EU Domain Names related to their prior rights), and 7 April, 2006 for open registrations, applications are starting now. Bearing in mind that the ‘First Come First Served’ rule also applies for the Sunrise period, your application and payment will establish the sequence in which we will be submitting your application.

Prices

All applications will be charged at $88 per year of registration. The additional fee for sunrise applications reflects the extra handling required to validate the claim of prior right.

Applicants not located in Europe will be charged an additional fee of $800 for a UK Limited company formation. This provides a legal European presence and will be sufficient to register your .EU domain name during Sunrise phase 2 or After Sunrise.

If a sunrise application is unsuccessful, the domain name fee of $88 will be credited to the customers members account with Instra, which they may use to apply for another .EU domain name. Sunrise application fees will not be refunded.

Application requirements for .EU Domains

An Applicant for a .EU Domain, whether during the Sunrise period or later, must meet the geographical requirements applicable to all .eu domain name holders as follows:

  1. Companies and organizations having their registered office, central administration or principal place of business within the European Community; or
  2. Individuals - natural persons – resident within the European Community.

Applicants that do not meet this requirement may still apply, by registering a UK Limited company in addition to their domain name. This provides a legal European presence and will be sufficient to register your .EU domain name during sunrise phase 2. Application Procedure

  1. Go to the Instra website - www.instra.com - and click the '.EU Domains Register Now' link.
  2. Enter the .EU domain name you wish to apply for, keeping in mind that the domain name must be IDENTICAL to your name or your company's name. Log in to your members account. If you are a new member, you can enter your details and sign up for your free members account.
  3. Enter the registrant's name. The registrant will be the legal owner of your domain name license. It should be either a company name or the name of an individual.
  4. Read the .EU documentation and select the sunrise options you require. Available options include Sunrise 1, Sunrise 2, and After Sunrise.
  5. Select your name server confirguration. Parking is recommended.
  6. Once your payment has been confirmed, your application will be date stamped and recorded in our system and in your account area. By submitting your application and payment now, you will establish your priority sequence in which we will be submitting applications to the Registry when the appropriate registration period opens.

Sunrise Period

The Sunrise period allows those with specific rights to a given Domain Name to obtain a name that EXACTLY matches their trademark or company name before the Registry opens up for ALL applications.

The Sunrise period consists of two phases each lasting two months. An extra charge will be made for evaluating a Sunrise period application.

Sunrise applicants will be required to provide the legal basis that grants the right in community law or the national law of the member state where the right is held, and provide the necessary documentary evidence to demonstrate the right under that law.

The required documentary evidence will not be required until the actual applications have been submitted to the Registry after the start of the Sunrise period and an initial check by the Validation Agent (PriceWaterhouseCoopers) has shown the applicant has the necessary priority.

Sunrise Phase 1

Public Bodies
During phase 1, applications can only be made for domain names that correspond with:
  1. The full name of a public body; or
  2. the acronym by which a public body is commonly know; or
  3. if applicable, the territory which is governed by a public body.
A ‘Public Body’ is the name of that body, for example, the City of Luxembourg, or the acronym under which it is known, for example ‘SNCF’ (the French Railways). Applicants are only accepted from the public bodies concerned.
Owners of Registered Trademarks
During phase 1, applications can also be made for domain names that EXACTLY correspond with:
  1. Registered EU Member States national trademarks; or
  2. registered EU Community trademarks.
May be applied for by the holder/licensee of the trademark. A ‘Registered Trademark’ is a National Trademark listed in any European Union country Trademark Register, or a European Community Trademark listed in their Register, in both cases that has completed the official waiting period for any Oppositions to be filed

Sunrise Phase 2

Other Rights (European Union Company and Individual Names, etc.)
During phase 2, applications can also be made for domain names that EXACTLY correspond with other rights that are protected under the national law of the member state where they are held. Other Prior Rights’ are rights that are protected under the national law of the member state where they are held such as:
  1. Company names (having a registered address in the European Union); or
  2. business identifiers (related to organizations with a registered address in the EU); or
  3. distinctive titles of protected literary and artistic work; or
  4. unregistered trademarks (still to be defined); or
  5. trade names (related to organizations with a registered address in the EU)

After Sunrise

All Other European Applicants
Applications after the sunrise period are for customers who do not qualify for sunrise applications. This includes all European companies and individuals wanting to register domain names that don't exactly match their name or their company's name. All .EU applications are processed on a first-come, first-serve basis, so it is important that you confirm your sunrise and after sunrise applications as soon as possible.
